Child support in Utah is set according to guidelines described in the Utah Child Support Act. Utah courts must follow these guidelines when making child support orders. Several factors go into determining how much child support must be ordered, including the incomes of the parties, the number of children, and the number of overnights each parent is entitled to have with the children each year.

Utah’s Office of Recovery Services (ORS) provides an online Child Support Calculator that will tell you how much child support you should be receiving, pursuant to the guidelines. ORS is a Utah government agency that collects child support for parents.

In Utah, your child support may be increased either through a motion or a petition. A motion is quicker and less costly, but a motion is not always an available option. If it has been more than three years since your child support order was issued or modified, then a motion can be filed, and the court will increase your child support if there is a difference of 10% or more between the amount you should be receiving and the amount currently ordered. You must also show that the difference is not temporary.

If your child support order was issued or already modified during the last three years, then a petition must be filed, and the court will increase your child support if you can show that: a) there has been a substantial change in circumstances since the last child support order was issued, such as a change in the income of the parents or your custody of the children; b) the change results in a 15% or more difference between the amount you should be receiving and the amount currently ordered; and the change is not temporary.
