How does the divorce process start?
The spouse starting the divorce case is the Petitioner. The other spouse is the Respondent. The Petitioner files the divorce petition in the county in which at least one of the parties has resided for at least three months immediately before filing the divorce petition. The Petitioner must serve the petition and a summons on the Respondent no later than 120 days after the petition is filed.
